Through an administrative resolution signed by the president of the Constitutional Court (TC)Luz Pacheco Zerga, the new remuneration scale for the workers of said institution was made official, among them the seven members of the Plenary Session who, starting next December, will receive a monthly remuneration of S/42,717.20.
In addition to Luz Pacheco, Helder Domínguez Haro, Francisco Morales Saravia, Gustavo Gutiérrez Ticse, Manuel Monteagudo Valdez, César Ochoa Cardich and Pedro Hernández Chávez will benefit from the measure. In total, their salaries will total S/299,020.40.
The standard, to which he had access Peru21was only made official last Thursday, November 6 after being approved by the Plenary.
Based on this, the Office of Management and Human Development is charged “with carrying out the corresponding administrative actions in order to make it effective as of December of this year.”
In its consideration part, the provision specifies that the measure is adopted under Law 32408, which establishes that the Constitutional Court is an autonomous body and that its workers are governed by the labor regime of private activity “so they are not included within the scope of the rules that regulate the management of human resources of the civil service.”
The aforementioned norm, in its third final complementary provision, exempts the Constitutional Court from the restrictions contained in the Budget Law, “allowing it to approve a new remuneration scale and call for a merit-based competition for the closed transfer to the entity of the other personnel hiring regimes that they have in order to cover the available positions and positions provided for in their management instruments.”
Law 32408 was approved by the Plenary of Congress in October, and the signature was sent to the Executive, but only this week was it promulgated by the President of the Republic, José Jerí; It also bears the endorsement of the president of the Council of Ministers, Ernesto Álvarez.
According to the new remuneration scale, officials such as the general secretary of the TC will receive 27,000 soles per month, while the head of the Cabinet of Jurisdictional Advisors S/21,000 and the rapporteur secretary S/22,800.
The lowest remuneration corresponds to an assistant with S/5,400.
It should be remembered that in recent weeks the Constitutional Court was at the center of the controversy. This is because five of its seven members voted in favor of the release of the former prime minister of the coup plotter Pedro Castillo, Betssy Chávez.
These are judges Helder Domínguez, Francisco Morales, Gustavo Gutiérrez, César Ochoa and Pedro Hernández. Only Pacheco and Monteagudo spoke out against it.
The measure allowed the former chief of staff—who has been on trial for the crime of rebellion and for whom the Prosecutor’s Office has requested 25 years in prison—to take refuge in the Mexican embassy, where she has been residing since last Monday the 3rd.
