The Constitutional Court approved Statutory Law 190 of 2022 (House) and 303 of 2023 (Senate), known as the law against digital fraud, a key advance to protect Colombians who have been victims of identity theft. The decision was ratified in ruling C-413/25, published in October, and establishes that financial and credit entities must suspend collections of credits, loans or services acquired fraudulently in the name of third parties.

With the new ruling, if a person reports having been impersonated, the bank or entity involved must stop the collections immediately and provide a copy of the documents used to approve the credit or contract, without being able to deny the information. This measure will apply once the affected person files their formal complaint with the corresponding entity, along with summary evidence that supports their claim.
From the notification, financial institutions will have ten business days to process the request, during which time they will not be able to continue demanding payments or initiate legal collections. In addition, they will be obliged to request the elimination of negative reports in risk centers such as DataCrédito or TransUnion, when it is proven that the debt was the product of impersonation.
During the investigation process, charges will remain suspended until a judge determines whether the complaint is true. If the court confirms the impersonation, the victim will be completely exonerated from payment, and all negative records or qualifications must be deleted immediately.

With this law, the Court seeks to strengthen the protection of personal data and offer a rapid response to the increase in cybercrimes in the country. The ruling represents a historical precedent in defense of financial consumers, who for the first time will be able to stop abusive collections of debts they never incurred.
