The Chamber of Deputies approved this Tuesday (4) the basic text of Bill 8,889/17, which provides for the collection of taxes for the streaming service. The deputies approved the text presented by the rapporteur, deputy Doutor Luizinho (PP-RJ).
The highlights, which may change the text, will be analyzed this Wednesday (5).
What was approved
The base text provides that streaming platforms will have to pay the Contribution for the Development of the National Film Industry (Condecine). So-called video on demand (VoD) services, such as Netflix, will have to pay the tax; television via apps, such as Claro TV+; and sharing audiovisual content, such as YouTube.
The tax will vary from 0.1% to 4% depending on annual gross revenue, excluding indirect taxes and including advertising revenue. Those with revenue of up to R$4.8 million will be exempt, which is the ceiling for small businesses in Simples Nacional.
VoD services will pay from 0.5% to 4%, with fixed deductible installments from R$24,000 to R$7.14 million in five bands. The sharing service will pay rates of 0.1% to 0.8%, with deductible installments of R$4,800 to R$1.4 million.
According to the report, the contribution may be reduced by 75% if more than half of the total audiovisual content offered by the platform is national.
According to the rapporteur, platforms can have up to 700 national works in their catalogue, as a way of meeting the minimum quota of 10% of Brazilian content.

Filmmakers, screenwriters, producers and audiovisual technicians protested this Monday (3) in several capitals against the bill.
According to the movement, the report “represents a historic risk of dismantling the national audiovisual industry”, as it contradicts Ancine’s technical opinion and the consensus built with civil society, and favors large foreign companies in the sector.
