ROI questions decision of the Council of the Judiciary on judges of the Supreme Court

The Network of Observers for Institutionality (ROI) expressed his deep concern for the arguments used by the National Council of the Judiciary (CNM) in it Minutes no. 010-2025through which he decided not ratify to the magistrates Pilar Jimenez Ortiz, Manuel Alexis Read Ortiz and Moisés Ferrer Landrón as judges of the Supreme Court of Justice (SCJ).

According to the official document, the decision was based on the fact that “the results do not meet the required suitability and performance standards”. However, ROI points out that the public evaluations carried out by the CNM itself show excellent grades in legal capacity, professional ethics, independence and fulfillment of duties.

For the organization, this incongruity between technical reports and the final result calls into question objectivity and transparency of the evaluation process.

In the case of the magistrate Manuel Alexis Read Ortizthe CNM would have considered its proximity to retirement age established in the Constitution (75 years).

ROI understands that, if that were the determining criterion, the judge should not have been subjected to evaluationsince the assessment should focus on performance, not on previously defined reasons for withdrawal in the law.

Furthermore, the record does not expressly mention age as a reasonwhich demonstrates—according to the entity—a discretionary application of criteria.

Regarding the judge Pilar Jimenez Ortiz, only woman evaluated At this stage, ROI warns that the minutes’ observations about its reasoned legal positions they turn out worrying and they could violate the principles of equality and judicial independence.
