Last October 30, Keiko Fujimori He announced his presidential candidacy for the fourth time with his political party, Fuerza Popular. At the rally he organized, held in the city of Trujillo, dozens of people gathered, who were recorded by an unimaginable video camera that had an inscription that said “Congress of the Republic.”
The complaint, filed by SolTV, stated that the audiovisual equipment used to record the orange proselytizing activity was property of Parliament. It had a sequential code and year of the general physical inventory in which it was recorded as a device owned by the State.
In this regard, on November 2, the Chief Congress Officer issued a statement in which it mentioned that, in effect, “the use of Congress property and public property in general is totally prohibited for private activities of any kind.”
In that sense, he mentioned, they requested to open an administrative procedure to sanction the worker who had taken the video camera for private purposes. He also requests that the sanction be given “immediately.”
The public servant involved, named Daniel Liza, presented his resignation letter to Parliament yesterday, November 1.
CLEAR RULES
In Peru, the use of State property for private purposes is prohibited by several regulations, mainly by Law No. 27815 – Law of the Code of Ethics of Public Service, which, in its eighth article, states that “public servants must not misuse State property or allow others to do so. It is prohibited to use public resources, facilities, vehicles, equipment or materials for their own benefit or that of third parties.”
As well as by provisions of Law No. 29151 – General Law of the National System of State Assets, which indicates in its article No. 49 that “State-owned assets must be used exclusively for public purposes and services. Their use other than that authorized is prohibited, except as expressly provided by law.”
The Penal Code even contemplates in article 387 that “the official or public servant who, for purposes unrelated to the service, uses or allows another to use vehicles, machinery, or any other property of the State, will be punished with a custodial sentence of not less than two nor more than four years”, for being immersed in the crime of embezzlement of use.
FUJIMORISM RESPONDS
In this regard, Fujimori congressman Arturo Alegría welcomed the beginning of the investigation to determine the responsibilities of the use of this public resource at the Fuerza Popular rally. In statements to Canal N, he confirmed that Edwin Lévano Gamarra, an orange militant, who heads the Citizen Participation Office of Parliament, where the video camera would have come from, was present at the proselytizing activity.
