This time it did not prosper. The Third Criminal Appeals Chamber of the Judiciary rejected the appeal filed by the Public Ministry to temporarily suspend the collection of tolls in the Lima Expresa concessionformerly called Yellow Line.
In this way, the Municipality of Lima will not assume the administration of the respective booths located on the Vía de Evitamiento and in the tunnel that passes under the Rímac River, as was the case. the request of the prosecutor José Domingo Pérez, of the Lava Jato Special Team.
According to Resolution No. 6, dated October 24, 2025, there is a contradiction in the request, because, on the one hand, suspending the operation would paralyze the company; while, on the other hand, appointing a judicial administrator would guarantee the management and continuity of resources to avoid criminal risks.
The members Arturo Mosqueira, Yeny Magallanes and Víctor Enríguez pointed out that, in accordance with article 313 of the Criminal Procedure Code, precautionary measures, such as the one presented by prosecutor José Domingo Pérez with the support of former mayor Rafael López Aliagamust meet certain requirements and be analyzed individually.
Due to this, the company Lima Expresa will continue to charge its toll of S/6.60 in the booths of Evitamiento, Monterrico, Separadora Industrial, Santa Anita, Ramiro Prialé, as well as those located in Estadio, Ejercito and Huánuco, which are on the route of the tunnel that goes under the Rímac River.
This ruling was made after the Prosecutor’s Office appealed the decision of Judge Jorge Chávez Tamariz, of the Seventh National Preparatory Investigation Court, who declared the request for temporary suspension of Yellow Line toll collection unfounded, on July 9, 2025.
This, within the framework of the investigations being carried out against the former mayor Susana Villarán and the Brazilian construction company OAS for alleged acts of corruption that led to extending the time of the project concession from 30 to 40 years.
This sentence is also known one day after the Judiciary ordered the company Rutas de Limaimmediately suspend toll collection at the Villa and Punta Negra stationslocated on the Panamericana Sur.
