He Congress continues to approve initiatives that will harm the country’s fiscal policy. In Thursday’s plenary session, Parliament gave the green light to the opinion that proposes incorporating Judiciary workers hired for an indefinite term under the CAS regime, to the regime of legislative decree 728.
However, the president of the Council of Ministers, Ernesto Álvarez, has already warned that the Executive is evaluating taking a case of an emblematic public spending initiative to the Constitutional Court (TC).
“The key to the economic Constitution is the mandate of budget balance, if that key is broken, we once again enter into a populist exercise and for that reason we must bring at some point that the cabinet foresees, an emblematic case to the TC so that it corrects its jurisprudence,” he indicated.
It should be noted that, in 2022, the Constitutional Court issued a ruling in which it opened the doors for Congress to promote laws that generate expenses for the State, something that was against what was stated in the Constitution.
“Article 79 of the Constitution does not prevent a legislative initiative from constituting a legal source so that, subsequently, and within the scope of the powers of the Executive Branch, it determines or considers the inclusion of the necessary items in the annual budget law to meet the expenses that may eventually be generated for its materialization,” the TC indicated at the time.
For the premier, it is necessary to reverse this situation because “we are not in the plan to demand between continuing to spend in a discriminated, populist way, or already applying austerity rules, which is what today’s Peru demands.”
In that sense, he considered that Dina Boluarte’s management sought to stay in office so he supported these legislative proposals, however, he noted that now the priority is to leave an immediate legacy for the country.
“To stay we are not going to affect the entire framework of the economic Constitution,” he stated and pointed out that they do not want to leave the next government with a fiscal disaster that ends up hitting all Peruvians.
BARRIERS TO BREAK
In this regard, the former Minister of Economy, David Tuesta, considered that if the Legislature insistently approves the autograph that authorizes the increase in teachers’ pensions, this initiative must go through the TC.
“The irresponsibility that exists in Congress is clear. In Parliament they have gone too far from any point of view, which is generating an explosion in the deficit, and that is a barrier that we must break,” he added.
In that sense, he considered that it is necessary to return to the interpretation of the Constitution in which it is established that the Legislature has no spending initiative.
