Osman Moroteone of the leaders of the terrorist organization Luminous Pathhe will not go free. The Judiciary ratified his life sentence due to his participation in the terrorist attack on Tarata Street, in the Miraflores district, in 1992.
This attack, it is recalled, caused the death of 25 people, left several injured and numerous material damages.
The Public Ministry reported that at the request of the Third Superior Criminal Prosecutor’s Office Specialized in Human Rights and Against Terrorism, the Judiciary ratified the sentence of life imprisonment against Morote by declaring inadmissible his request to be released, alleging alleged conditions against his dignity and health in the Ancón 1 penitentiary center where he is being held.
Morote’s legal defense made the request under Law 32181, which allows prisoners over 80 years of age to be released.
At the public hearing, senior deputy prosecutor Pedro Orihuela Santana, however, argued that Morote does not meet the necessary conditions to qualify for this benefit since he did not prove the situation of extreme and irreversible physical and mental vulnerability.
Likewise, he specified that the sentence against Morote, at the time, determined that he committed “acts in an indiscriminate and cruel manner, without the slightest respect for the right to life of the victims and society.” He also described him as a “felon by conviction.”
In the ruling, a series of elements were also taken into consideration, including the effect that an eventual release of the Shining Path leader would have on public safety and the right of the victims to access justice.
