He National Election Jury has decided to declare the appeal he filed unfounded Cesar Acuñaformer governor of La Libertad, confirming that he committed a violation of the principle of state neutrality.
This is due to his participation in a political rally of the Alliance for Progress on September 20 in Huancayo. The case originated from a previous resolution of the Special Electoral Jury of Huancayo, which identified acts of electoral propaganda and favoring his party.
In his defense, Acuña pointed out that he acted as a citizen and not as a governor, arguing that the support shown by those in attendance was spontaneous; however, the JNE rejected these arguments.
Thus, the JNE confirmed the violation of the principle of state neutrality committed by Acuña, also determining that his statements and actions during the rally constituted electoral propaganda and that the indirect allusion to his position met the conditions to constitute the offense.
This resolution also establishes a mandatory criterion for future similar cases. According to Acuña, this sanction violates principles such as legality and proportionality.
The National Elections Jury determined that the infraction for belonging to a political committee is not determined by membership alone, but by specific acts that favor electorally.
