The Constitution and Justice Committee (CCJ) of the Senate approved this Wednesday (22), Bill (PL) 120/2020, which establishes that passengers on national and international flights will be able to transport up to 10 kilos of hand luggage, with standardized dimensions, free of charge, without additional charges from airlines. The matter goes to a vote in the Chamber of Deputies. 
The proposal, authored by senator Randolfe Rodrigues (PT-AP), was reported by Veneziano Vital do Rêgo (MDB-PB) and changes the Brazilian Aeronautics Code to close loopholes that, according to the rapporteur, allow abusive practices.
The project sets parameters for the transport of hand luggage on domestic and international flights, defining that the minimum free allowance will be up to 10 kilos. The standard will apply to the upper compartment of the cabin, and companies may establish additional restrictions only for reasons of safety or aircraft capacity. In case of overcrowding, the operator must dispatch the volume at no cost to the passenger.
The proposal prevents companies from charging for hand luggage, a possibility opened up by a 2016 resolution from the National Civil Aviation Agency (Anac), which does not determine free transport of this type of luggage, which created room for extra fees.
The rapporteur stated that the project offers a definitive legislative solution and avoids depending on administrative regulations that vary according to company policies or Anac decisions.

Chamber
Yesterday (21), the Chamber of Deputies approved the urgency of the Bill (PL) 5041/25 which prohibits airlines from charging for hand luggage. With approval, the project can be voted directly in the plenary, without the need to go through committees.
The movement of Congress in relation to the issue is a response to the decision of the implement a new fare categorycalled “basic”, for transporting luggage. Recently, Gol Linhas Aéreas and Latam Airlines announced the adoption of new fares with restrictions on second hand luggage, starting this month.
