The First Panel of the Federal Supreme Court (STF) defined this Tuesday (21) the sentences of the seven defendants of Nucleus 4 of the coup plot that occurred during the government of former president Jair Bolsonaro.
Earlier, by 4 votes to 1, the majority of the collegiate ministers agreed with the complaint from the Attorney General’s Office (PGR) and sentenced the accused. The collegiate understood that the defendants promoted disinformation actions to propagate false news about the electoral process and virtual attacks on institutions and authorities in 2022.
Check out the defendants’ sentences:
- Ângelo Martins Denicoli (Army reserve major) – 17 years in closed prison;
- Reginaldo Vieira de Abreu (Army colonel) – 15 years and six months in closed prison;
- Marcelo Araújo Bormevet (federal police officer) – 14 years and six months in closed prison;
- Giancarlo Gomes Rodrigues (Army warrant officer) – 14 years in closed prison;
- Ailton Gonçalves Moraes Barros (Army reserve major) – 13 years in closed prison;
- Guilherme Marques de Almeida (Army lieutenant colonel) – 13 years and six months in closed prison;
- Carlos Cesar Moretzsohn Rocha (president of Instituto Voto Legal) – 7 years and six months in a semi-open regime.
The defendants were convicted of the crimes of armed criminal organization, attempted violent abolition of the Democratic Rule of Law, coup d’état, qualified damage through violence and serious threat and deterioration of listed property.
Carlos Carlos Cesar Moretzsohn was the only one convicted of only two crimes: armed criminal organization and attempted violent abolition of the Democratic Rule of Law
The accused will not be automatically arrested because defenses can appeal the conviction.
Indemnity
Due to the conviction, the convicts must also pay R$30 million jointly for the losses caused by the depredation of public buildings during the coup acts of January 8th. The amount will be shared with the others convicted of the coup plot. Furthermore, they are ineligible for eight years after serving their sentence.
The soldiers must be judged by the Superior Military Court (STM) in an action to lose their official status.
Other cores
To date, the STF has already convicted 15 defendants for the coup plot. In addition to the seven sentenced today, the Court has already sentenced eight more defendants, who belong to Nucleus 1, led by former president Jair Bolsonaro.
The core 3 trial is scheduled for November 11th. Group 2 will be judged from December 9th.
Nucleus 5 is formed by businessman Paulo Figueiredo, grandson of the former president of the dictatorship João Figueiredo. He lives in the United States and did not present a defense in the process. There is still no forecast for the trial.
