José Domingo Pérez does not rule out resigning after the Cócteles case is filed: "The possibility is latent"

The prosecutor of the Lava Jato Special Team, Jose Domingo Perezdoes not rule out the possibility of resigning from the Public Ministry, after the Constitutional Court (TC) ordered the filing of the Cocktails casewhich involves the leader of Fuerza Popular, Keiko Fujimori.

During an interview for Hildebrandt in his ThirteenPérez Gómez considered that, after the ruling of the T.C.political and not legal reasons were taken into account. Furthermore, he assured that “the attack will continue” by various political authorities.

“Well, the possibility is latent because if there are going to be acts of harassment, beyond what the pestilence does in the workplace, in my house, the institution itself does it through this persecution that Mrs. Fujimori already announced. Mrs. Fujimori announced today, there will be persecution for the prosecutors who have heard about this case and the Congress of the Republic already has a commission,” he commented.

When asked about a possible complaint by Fuerza Popular against him, the prosecutor indicated that “this always comes from criminal organizations that are investigated, always seeking to affect the prosecutors who carry out their work.”

“It doesn’t strike me that it is threatened in that order (…) Well, I think it is clear that what I have always been stating, that they were trying to seek some type of instrumentalization in constitutional justice, has finally occurred,” he said.

“It seems that these people don’t understand that we are not in the ’90s. There is a separation of powers,” Pérez Gómez said. However, the journalist refuted him: “Are you sure we are not in the 90s?” “Well, I’m still in the Prosecutor’s Office. If I have to leave the Prosecutor’s Office due to the arrogance of these people, surely what you had indicated a few moments ago about the coup d’état has already been consummated,” he said.

TC brings down the Cocktails case: orders to file accusation against Keiko Fujimori

Last Monday, October 20, the TC ordered to archive the investigation known as “Cocktails Case“, which involved the leader of Fuerza Popular, Keiko Fujimoriand 14 other people, accused of alleged money laundering and criminal organization. According to the decision of five judges of the TC, the accusations related to contributions to the 2011 and 2016 presidential campaigns lacked legal basis.

As indicated in the resolution of the highest interpreter of the Political Constitution, the crime of money laundering in the form of asset receipt was incorporated into the legal system on November 26, 2016 through Law 27765. This means that the alleged crimes attributed to Keiko Fujimori would have been committed before the entry into force of said law.
