Supreme Court urges to preserve democratic principles

In an extraordinary session held this afternoon, the Plenary Chamber of the Supreme Court issued a public statement in which it calls on the authorities and citizens to preserve the fundamental principles of democracy, such as separation and collaboration between powers, respect for legality, and political and social pluralism.

The highest body of the Judiciary stressed the importance of maintaining institutional balance in the context of the current national situation. “We must not renounce the rocky principles of a democracy,” the statement says, referring to the constitutional pillars that support the republican system.

The Court also ruled on the right to protest, highlighting that its exercise must be peaceful and respectful of other fundamental rights, such as life, integrity, dignity and property. In this sense, he urged the authorities to act with prudence and proportionality, avoiding any violation of the rights of peaceful protesters and effectively containing those who transgress the rules of coexistence.

“Protest, as a fundamental right, must be exercised with respect for other fundamental rights (life, bodily integrity, dignity and public and private property) and its exercise, in addition to being peaceful by those who exercise it, must be respected by the authorities, called to act prudently and proportionally,” he noted.

In another passage of the statement, an explicit call was made for dialogue between public powers and civil society, pointing out that “in democracy it is always possible to achieve consensual objectives of freedom, justice and social development.” The Court warned about the risks of adopting authoritarian positions that contravene the common good and constitutional principles.

The statement also expressed concern about the increase in homicides in the country, recalling the murder of two justices of the peace in their offices, an event that has shocked the Judiciary. The institution reaffirmed that jurisdictional power is essential to guarantee justice, legal security and equality.

Finally, the Supreme Court urged the national community to make efforts in favor of peace, freedom and social justice, acting with consideration and commitment to the values established by the Constitution.
