Heavy fine. This Monday, the Consumer Protection Commission No. 3 of Indecopi ordered the maximum sanction against the company Medifarma SAa decision in the first administrative instance that amounts to 450 UIT, an amount that is equivalent to S/ 2,407,500.
This fine was applied to the company for distributing a defective batch of 9% physiological saline in the Peruvian market, which according to the entity posed an unjustified risk to the health and safety of consumers.
The measure is taken after cases of affected patients were reported, as well as a “regrettable number of fatalities.”
Indecopi verified the existence of failures in Medifarma’s production processes, which were under the company’s control and were the cause of the distribution of the product that put the health of Peruvians at risk.
Apart from the million-dollar fine imposed against the company, it must also comply with 3 points, according to the sanction imposed by Indecopi:
These are to cover the medical expenses necessary for the “full recovery of the victims”, to cover the funeral expenses of those who died due to the defective saline solution, and to implement a regulatory compliance program.
The resolution is currently within the deadline to be appealed.
