They present a bill to exclude vacant presidents from life pensions

Congressman Alejandro Muñante presented a bill that seeks to prevent former presidents vacated by Congress from receiving the lifetime pension granted by the State to those who finish their term legitimately. The initiative would affect the coup leader Pedro Castillo and also Dina Boluarte, recently removed from office through this parliamentary procedure.

The proposal of the Popular Renewal legislator proposes modifying Law No. 26519, which regulates said benefit, in order to avoid new controversies such as the one that arose around the Castillo case.

The text proposes to incorporate a new article 2-A, which specifies that former presidents dismissed for the reasons established in article 113 of the Constitution will not have the right to a life pension. These include permanent moral or physical incapacity, acceptance of resignation, departure from the national territory without authorization from Congress or dismissal for constitutional violation.

The document explains that the purpose of this project responds to a “legal loophole” that allowed the Judiciary to recently order Parliament to grant a pension to Castillo, despite having been vacated in December 2022 after his attempted coup d’état.

The congressman argues that the lifetime pension does not constitute a pension right, but rather an honorary recognition reserved for those who concluded their management in accordance with the Constitution.

“He who betrayed his constitutional oath or was dismissed for moral incapacity cannot receive a pension from the State,” reads the letter that was submitted by the Congressional parties just hours before Boluarte’s vacancy was approved.

The project also seeks to strengthen the principles of ethics and political responsibility, pointing out that excluding the cows from the benefit will contribute to preserving the legitimacy of democratic institutions.

Last June, the Dina Boluarte government approved the new presidential salary, establishing it at S/35,568 within the framework of the provisions of the Civil Service Law (Law 30057).
