TC will say next week whether the Cocteles case is filed or not

The decision has already been made, the only thing missing is the signatures. The president of Constitutional Court (TC), Luz Pacheco, reported that next week the ruling will be published regarding the habeas corpus appeal presented by the legal defense of the leader of the Fuerza Popular party, Keiko Fujimoriwith which they seek to archive the so-called Cocteles case.

“It is an issue that we have already discussed, it has been in the debate. I think it will be published next week, anyway. The debate has already been exhausted and all that remains is the signature process and it comes out. There is already a decision, (but) as long as it is not published, we cannot advance the meaning of the ruling,” he said.

For the Cocteles case, it is recalled, the Public Ministry requested a sentence of 30 years and 10 months in prison against Fujimori for the alleged commission of the crimes of criminal organization, money laundering, obstruction of justice and false declaration in administrative proceedings. According to the fiscal hypothesis, however, the dinners for which they claimed to have charged up to US$500 would have been a facade to allow irregular contributions from the Odebrecht firm and other Brazilian construction companies to enter the group.

Pacheco did not give details of the content of the TC resolution. However, when asked about the impact the measure would have, she responded briefly: “I have repeated more than once that where there is the same reason, it is the same right, but I also understand that each case is unique; both things.”

It is worth remembering at this point that last year the Constitutional Court annulled the tax accusation against the former general secretary of Fuerza Popular José Chlimper, who was excluded from the trial for the Cocteles case arguing that his right to defense was violated when he was tried for crimes for which he had not been investigated.

Under this measure, several of the defendants, including Keiko Fujimori, requested that the same TC ruling be applied to them. If the request of the president of Fuerza Popular is attended to, it will be known in the coming days.

In his accusation, prosecutor José Domingo Pérez requested prison for the Fuerza Popular leader, but also her disqualification from holding public office for 15 years and 5 months.
