The Attorney General’s Office (FGR) determined that it will not take any criminal action against Flavio Cienfuegos Valencia, who was accused in 2019 by Germán Martínez Cázares, then director of the Mexican Social Security Institute (IMSS), for alleged illicit exercise of public service, as well as irregular use of powers and powers.
According to Martínez Cázares, current PAN deputy, Cienfuegos Valencia, who was director of administration of the IMSS – and years later was head of the office of the presidency of the National Electoral Institute (INE) – did not attend to delegates from the health institute, for which he filed complaints.
The Ministry of Public Administration (SFP) initially concluded that there was no reason to sanction. Now the FGR closes the case, maintaining that the reported events “did not occur.”
Although years later there was already progress regarding the lack of evidentiary elements, at the time that was an allegation in the INE to prevent the appointment of Cienfuegos to the executive secretary of the electoral body, the second most important position in the institute.
In the General Council of the INE it was argued that the official, who was the right hand of the Presidential Counselor Guadalupe Taddei, did not meet the requirements, so they would opt for a woman for the position.
As established in the National Code of Criminal Procedures, the FGR proposed the “non-exercise of criminal action.” The result of the investigation was communicated to the legal representative of the IMSS. “In the event that the indicated period elapses and no challenge has been filed before the control judge, the matter will be completely concluded,” reads the FGR letter.
In the document and in the investigation folder it is established that the matter began on June 14, 2019, supposedly because the person involved did not respond to the requests of the delegations, particularly in relation to the supply of medicines, operation of medical units, ambulance transfer service and the hiring of personnel.
The agents of the federal public ministry carried out multiple procedures and, like the SFP, concluded that there was not enough evidence.
Counselors appear for administrative offenses
On the other hand, yesterday, through their lawyers, INE counselors accused by Morena appeared before the Internal Control Body (OIC) of said institute, allegedly for incurring serious administrative offenses.
The complaint was filed in December 2021 by the then representative of the Guinda party, Sergio Gutiérrez Luna, against six councilors (three still in office: Dania Paola Ravel Cuevas, Jaime Rivera Velázquez and Beatriz Claudia Zavala Pérez) who voted in favor of extending the mandate revocation process, alleging insufficient resources to do so.
The consultation was carried out in April 2022 by order of the Electoral Court, which caused the Morenista’s complaint to be ineffective, as the same court indicated in an official letter.
However, the OIC continues with the procedure against the directors, who pointed out that it is a serious fact that they are called to account for a legal criterion, in this case, for the meaning of their vote.
