The Senate approved the Bill (PL) 4,871/2024, which establishes the automatic portability of wages and the automatic debt between financial institutions. The text goes to the sanction of President Luiz Inacio Lula da Silva.
Among other points, the project determines as users’ rights automatic salary portability; automatic debit between institutions; Right to information; and hiring special credit with reduced interest.
The matter states that the institution of origin will not be able to refuse the request for salaries, earnings, welding, pensions, pensions and the like, unless there is a clear and objective justification, and will have two business days to make the transfer.
The project also establishes that the customer can pay loans from a banking institution using funds stored in another through automatic debit.
The text also establishes the creation of a new type of credit, with lower interest than those practiced in the market. To have access to the new sport, the customer is unable to cancel the automatic debt of the installments of this loan until discharge; is subject to the possibility of attachment of the part of the salary that exceeds the amount corresponding to 20 minimum wages; Receiving citations and personal subpoenas by email, among other rules. The modality should still be regulated by the Central Bank (BC).
Another expected point is that financial institutions and institutions authorized by the Central Bank should make prior communication to their clients on changes in interest rates on the credit operations debtor in pre-approved and rotating modalities, including credit cards and other postpaid instruments.
Communication should be done at least 30 days in advance and observing the use of accessible language.
