The Second Chamber of the Supreme Court of Justice (SCJ) annulled the resolution issued by the Third Chamber of the Criminal Chamber of the Court of Appeal of the National District of the controversial case of the irregular sale of the land of the three arms and ordered that the file be forwarded to another appeal room for knowledge.
The SCJ-SS-25-0793 judgment, released on July 31, 2025, establishes that the Court of Appeal violated fundamental principles of due process, the contradiction, orality and the right of defense, by deciding on the Board of Council and without holding hearing on appeal resources filed by the Public Ministry and the complainants against the declaration of extinction of the criminal process.
The SCJ considered that the contested decision lacked sufficient motivation and injured the rights of the parties, which generated a state of legal insecurity. Consequently, he ordered that the presidency of the Criminal Chamber designate a different room, with the exception of the first and third that already knew aspects of the process, to know the merits of the resources.

The case reopens the investigation into the controversial sale of state land in all three arms
The case, which originated after investigations on the sale of state land in the Los Tres Armanda sector, has been marked by judicial resources and controversies since 2016.
The Supreme Court reiterated that justice must act with transparency, motivation and respect for due process, guaranteeing the parties the possibility of defending in equal terms. With this decision, the SCJ did not solve on the bottom of the accusation or on the extinction of the process, but the judicial route reopens, returning the case to appeal and prolonging one of the most sounded investigations around the state heritage in the last decade.
The judgment subject to appeal was 941-2024- SSEN-00082, dated April 22, 2024, issued by the Fourth Collegiate Court of the Criminal Chamber of the Court of First Instance of the National District, in whose device: “declared the extinction of the criminal action for expiration of the maximum duration of the process, in favor of the accused Leoncio Almánzar Objío, Manuel Joaquín Aybar Ferrando, Manuel Joaquín Aybar Ferrando, Irving José Cruz Crespo, Juana Ynés Gómez Williams, Carlos Aris Gómez Williams, Julio César Gómez Williams, Domingo Gerardo Lebrón de los Santos and Lisetel González Sánchez ”.
