The amparo reform will be voted on Wednesday morning in commissions of the Senate and it is expected that at night the legislators will be considered in a plenary session, an opinion that includes 15 changes, including a background one referred to the figure of legitimate interest.
This was one of the points of the initiative of President Claudia Sheinbaum that generated the most disagreement not only between sectors of the right, but even in Morena legislators and in social organizations, such as the Miguel Agustín Pro Human Rights Center.
In the name of that group, Ivette Galván García, during the second audience around the initiative, commented that it is a regressive proposal that vanis a decade of advances that made possible, for example, equal marriage, the defense of the environment and reproductive rights, because it only protects individuals and not groups.
Other speakers, as former magistrates and representatives of Bar Associations, also demonstrated against the drafting of the Fifth article of the Amparo Law in which it is required: “In the case of the legitimate interest, the norm, act or omission claimed, must cause in the person complaining a real, current and differentiated legal injury from the rest of the people, in such a way that its annulment produces a certain benefit, a certain benefit is a certain benefit. or eventual, in case the amparo is granted. ”
The modification proposed by the ruling commissions recognizes that the legitimate interest can be of individual or collective nature and does not necessarily require that the injury be “current” or that the benefit derived from the amparo is direct. With this, the defense of collective rights is included.
In this regard, the president of the Commission of Legislative Studies, Enrique Inzunza, considered that this is a substantive change that ends with the objection that various sectors had formulated to the presidential initiative.
Also in article 135 changes are raised, in order to give greater clarity to the guarantee media to obtain the suspension in amparo judgments against acts of collection of firm tax credits.
There were also adjustments to the reform to expand the procedural deadlines and the period was increased by 60 to 90 to 90 days for the judges to issue a sentence in indirect protection, in harmony with the jurisprudence of the Supreme Court of Justice of the Nation.
Provisions were suppressed that limited the imposition of fines and criminal sanctions to authorities responsible for breaking suspensions and amparo sentences.
The Justice Commissions, Legislative Studies and the Treasury will present the changes to the initiative of President Sheinbaum at the extraordinary meeting convened for today morning.
The opinion that is approved will immediately turn to the board of directors so that it is in the first reading and can be discussed in a second session that will be convened at night and it is expected to last for several hours.
