The Ombudsman’s Office intervened in the District Municipality of El Tambo (MDT) to guarantee the right to protest of Rafaela Mallma, a citizen who has remained at the door of the municipality for more than a month demanding the attention of his claim.
The alarm arose when his family denounced an alleged attempt to evict from the commune, which motivated the immediate presence of the Head of the Regional Office of the Defensoría, Mario de la Cruz. The official recalled that the Constitution, in its article 2 subsection 12, covers the right of every person to demonstrate and present their claims, provided that public services are not affected.
“The lady’s stay does not prevent any service provided by the Municipality, therefore there is no legal basis to dispose of an eviction”, He pointed out De la Cruz, who warned that if a measure of force was executed despite the recommendation, those responsible would incur administrative and even criminal responsibilities for abuse of authority. In addition, the defender reported that the municipal manager, Rubén López, would have signed an act in which he undertakes to respect the right to citizen’s protest.
López said that the request for retirement started from a memorial presented by a group of neighbors and that the commune had only consulted the attorney to evaluate the origin of the petition. The Ombudsman left, sitting that any eviction action would lack legal support and that the protest has constitutional support.
