Interpol Paraguay Chief, Julio Maldonado, gave details about the legal situation of Erick Moreno Hernández, aka “The monster”recently arrested in San Lorenzo.
He explained that the extradition process requested by the Peruvian authorities could extend up to 60 days, unless it is decided to formally withdraw orders, which would allow a faster return via administrative expulsion.
Maldonado said that the captured entered Paraguay irregularly, which strengthens the possibility of applying this route.
“Your immigration status is irregularly … It has no legal income”he pointed to Channel N. However, he reiterated that this alternative would only be effective if the extradition orders presented by Peru are raised before the Paraguayan justice. “If Peru decides to lift this order the expulsion would be given in a matter of hours”he said.
Currently, the required one faces a red notification of Interpol and three extradition exhorts studied by the Peruvian Judicial Power.
“This person (Erick Moreno) has a record notification requested by agents in Lima (…) has an extradition request for extradition by the judicial authorities of Peru”Maldonado commented. These documents are under analysis in the Judicial System of Paraguay, which prevents an immediate decision on the delivery mechanism.
After his capture, Moreno was filed before a court through Telematics Hearing. As a precautionary measure, the judge ordered his transfer to a maximum security penalty in ambush while his procedural future is defined.
“He was made available to the Court (…) ordered that the person be treated soon to a maximum security prison center.”referred to the head of Interpol.
As for the deadlines, Maldonado warned that the ordinary extradition procedure could extend up to two months. “The extradition procedure can last 60 days […] But if it pales, it is much shorter “he detailed.
