The rest of the people included in this trial have no responsibility,” said the former Burgomaestrus in an interview with RPP moments before presenting himself to the third Criminal Court of Collegiate.

Villarán refused to give the exact amount he received from Odebrecht and OAS and said that the figure managed by the press (US $ 11 million) is false.

When he reached the court, the eloquence he showed in his statements, was not the same as in his radio interview.

Upon reaching the judicial headquarters, and before the insistence of the press, he only managed to a few words: “I have waited for many years to open the truth. I ask for justice, respect, impartiality and that the truth is opened.” In the diligence he chose silence.

During the installation hearing, not only the case of Villarán was seen, but also of another 20 defendants, including José Miguel Castro, who died in tragic circumstances without even knowing if his death was a crime.

Prosecutor José Domingo Pérez, who supports the accusation, seeks that the mayor’s ex -authority be imposed 29 years in prison for the crimes of illicit association, money laundering, collusion, false statement and ideological falsehood.

What about ‘Budé’?

On June 29, the former municipal general of Villarán, José Miguel Castro, was found dead at his home in Miraflores. The former official, who aspired to be an effective collaborator, was slaughtered in the bathroom of his home. Although, according to the Public Ministry, Castro was in charge of receiving and managing the bribes of the Brazilian companies, his testimony has been invalidated. Although the Prosecutor’s Office argues that it has more evidence that will demonstrate the guilt of Villarán and the other defendants.

Yesterday, during the hearing, the Attorney General’s Office asked to incorporate Castro’s hereditary succession, which are the widow Paula Maguiña and her two children. In this way, it aims to collect an eventual civil reparation. The court agreed to the request.

The details of the session

Although the September 23 session was installation, the court made important decisions in the case.

For example, the magistrates arranged not to start the trial against José Pinheiro, former executive president of the Brazilian construction company OAS.

As is known, according to prosecutor Pérez, the company allocated Millionaires fertilizers to Villarán in exchange for the concession contract of the Yellow Line toll is extended from 30 to 40 years.

The decision was made despite the request of the Attorney General’s Office, which requested that Pinheiro be declared contumaz and his international capture was issued, arguing that he did know the hearing, because his lawyer was present.

The Court justified its decision by pointing out that a personal notification had not been made to the accused.

Therefore, it was ruled that the process against Pinheiro will continue in a “special notebook” until the effective notification is achieved. This decision did not delay the continuation of the trial.

Pinheiro’s lawyer also sought to prescribe two crimes of his defendant; However, the Coronado Judge indicated that it would not be possible, since there was no installation of the trial against the former OAS manager.

“From any prescription approach we must hear the facts and it is unfeasible because we have not heard the allegations of the Prosecutor’s Office. We will enable an audience on that at that time,” said the magistrate.

As reported by Judge Coronado, today September 24 will resume the hearing in person. The Prosecutor’s Office and the Attorney General’s Office requested three and two hours for their allegations, respectively.
