The president of the Chamber of Deputies, Hugo Motta (Republicans-PB), rejected today (23) the nomination of Deputy Eduardo Bolsonaro (PL-SP) to exercise the minority leadership in the house. Eduardo asked for a position of office in March and traveled to the United States, where he settled residence.
The license ended on July 21, but the parliamentarian has not returned to Brazil and has accumulated non -justified absences in plenary sessions. The indication of the parliamentarian for the minority leadership was pointed out as a maneuver to prevent the parliamentarian from suffering punishment, such as the loss of mandate.
The Constitution provides for the cancellation of deputies that are missing 1/3 of the ordinary sessions, except license or authorized mission. Eduardo Bolsonaro’s nomination was made by PL leader, Deputy Sostenes Cavalcante (PL-RJ), with the argument that an act of the Board of Directors, edited in the management of Eduardo Cunha (MDB-RJ), released party leaders to record the empplenary presence.

“The absence of prior communication on the removal of the national territory, as occurs in the case under analysis, constitutes, in itself, a violation of the functional duty of the parliamentary,” says the decision of the General Secretariat of the Bureau.
The document also says that this omission prevents the absence from being framed as a regimental exception. “A removal not communicated to the presidency of the House cannot, from any perspective, be considered an authorized mission, as it lacks the essential elements of authorization, formality and official science,” summarizes the opinion.
