Minister Dias Toffoli of the Federal Supreme Court (STF) gave ten days for the House of Representatives to speak about the processing of the Proposed Amendment to the Constitution (PEC) that restricts the opening of investigations against deputies and senators.
The minister’s order was issued in the writ of mandamus filed by Federal Deputy Kim Kataguiri (União-SP) to suspend the process of PEC, which was approved by the house on Tuesday (16).
After receiving the demonstration of the House, Toffoli must analyze the suspension request.
Early, the PT, PSB and PSOL leaders also entered the STF to suspend PEC. Toffoli should also report this action.
The parties question the lack of submission of amendments within the regimental period and prior advertising of the opinion of the rapporteur, in addition to the convening of the deliberation sessions without minimal in advance to vote on the proposal.
After the approval of the PEC, the article was sent to the Senate. In case of approval, the proposal will be promulgated by Congress and will come into force.
PEC determines that any opening of criminal action against parliamentary depends on prior authorization, in secret votethe absolute majority of the Senate or the House. In addition, the proposal grants forum in the Supreme to party presidents.
