This decision responds to a request for the defense of Castillo, who requested control of the procedural term, arguing that the Prosecutor’s Office had excessively used the time destined for investigation. The magistrate considered that, after the 60 days of preliminary proceedings initiated on May 20, the deadline was given on July 20, so the ex -president’s claim is founded. In addition, Checkley Soria said that preliminary proceedings are not contemplated the extension of the term, less extension, and emphasized that interpreting it otherwise would be to denaturalize its purpose.
