Amnesty Law: relatives of victims warning that demand of unconstitutionality will formalize impunity

Relatives of victims of the internal armed conflict, warn that demands of unconstitutionality presented by the Ombudsman, Josué Gutiérrezagainst the amnesty law seeks to prevent judges from applying diffuse control to inapply the norm, as has been happening. Gisela Ortiz: They will force the judges to abide by

Gisela Ortiz Perea, whose brother was kidnapped and killed by the Military Detachment Colina in July 1992 in the operation at La Cantuta University, said that, by the statements given by some members of the TC, they will surely declare the action unfounded.

“We demand from the Ombudsman to withdraw that lawsuit because it will end up affecting the little justice that the victims have reached, and what the judges are solving in the case of amnesty, according to the human rights protection system,” he said.

He recalled that, a few months ago, this same Ombudsman supported the norm to give amnesty to military, police and self -defense members through a document sent to the Constitution Commission, although on previous occasions he had opposed.

“In full discussion of Amnesty’s law, they have gone to defend it, noting that the military is many years in judgments. If that has been their attitude in the process, why now have an unconstitutionality action?

He argued that “they are forcing the TC to pronounce for the constitutionality of the norm, and with that force the judges that abide by it.”

Scharmelí Bustíos: Before the Ombudsman saw for the victims

Sharmelí Bustíos, daughter of the murdered journalist Hugo Bustíos in Huanta in 1988, joined the voices of relatives who urge the Ombudsman to withdraw the demand for unconstitutionality.

“We know how the Constitutional Court was elected and how it has acted on human rights issues, turning the backs on relatives that for years we have been looking for justice. And now the Ombudsman does, when they really thought about the most affected,” he said.

He added that the amnesty law affects the right of family members to justice, who for years have fought so that those responsible are sanctioned. “They say that it is for those who defended the country of terrorism, but it is not for the good military and police who did, but for the bad troops who did not honor the uniform, and murdered, tortured and executed innocent people,” he said.

In 2023, for the death of his father they condemned former minister Daniel Urresti, who in 1988 was Chief of Intelligence of the Castropampa Barracks, and has now asked to take advantage of Amnesty’s law.

Pulido Cirila: Let it be put in our place

Pulido Cirila is a survivor of the massacre of 69 people in the Ayacuchana community of Accomarca in 1985, including several children. He saw his mother and 8 -month -old little brother die. Now he feels outrage at Amnesty’s law and also asks the Ombudsman to withdraw the appeal that will only delve their wounds.

“That he withdraw that demand. It is not fair that we spend so many years of struggle so that everything is left with that law in amnesty. That he puts himself in our place, what would he feel if he passed him,” he asked.

She was 12 years old when the Army troops entered and could escape a hill, from where she saw crimes without being able to do anything. “I was in the sentence and I thought we finally achieved justice for our relatives. Now with this amnesty you have to start over,” he said.

Santos Cayllahua: they will tie the hands of the judges

Santos Cayllhua lost his father in 1990. Army and police arrived at his home, in Chuschi, and took him along with other settlers. Since then they are missing. He said that a sentence has been issued against some of those responsible, but they are fugitives, and the process has been reserved for others that never appeared. He feels that he did not reach justice, which will be formalized with the amnesty.

“The Ombudsman has not had a rejection of that law, so we think that the objective of going to the Constitutional Court has the objective of binding the judges for those responsible for those responsible to be released,” he said.
