The Plenary of Congress of the Republic It approved, unanimously, the opinion that modifies articles 108-C and 108-D of the Criminal Code (Legislative Decree 635) to strengthen the fight against the sicariato. The proposal received 106 votes in favor and was exonerated from a second vote.
With the modification, it is established that whoever kills another person by order, commission or agreement, in order to obtain an economic benefit or other type of advantage, will be sanctioned with a deprivation of liberty not less than 30 years, in addition to the disqualification indicated in numeral 6 of article 36. The same sanction will fall on those who order, commission, agree or act as intermediaries in an act of sicariate.
Likewise, the norm raises the sanction to life imprisonment when the crime is committed using a minor or an unimputable person.
The president of the Justice Commission, Flavio Cruz Solórzano, explained that Sicariate is one of the fastest growing crimes in the country.
According to figures from the National Police and the INEI, in 2024 an average of three murders were registered per order per day. “This phenomenon impacts not only on the lives and integrity of people, but also on citizen security, internal order and economy, affecting transport, trade and public services,” he said.
Cruz remarked that the opinion seeks to harden the penalties typified in articles 108-C (sicariato) and 108-D (conspiracy and offer for sicariato), in addition to expanding aggravating.
“It responds to the citizen security crisis considering that in 2023 more than 570 thousand complaints were registered for crimes with a strong presence of homicides and extortion. It closes legal empty and strengthens the punishment of the phases prior to the sicariato,” he added.
