Minister Alexandre de Moraes of the Federal Supreme Court (STF) said on Tuesday that handwritten notes on an agenda and documents with “thoughts” about an electronic one were the initial acts of an attempt to coup d’état for the benefit of former President Jair Bolsonaro, and that these items prove the existence of the plot. 
In making the statement, Moraes removes one of the main arguments of some defenses, that these evidence would only be cogitations and ideas that could not be considered criminal acts.
Moraes referred and showed images of an agenda belonging to Army General Augusto Heleno, former chief minister of the Institutional Security Office (GSI) and one of the eight defendants in the action. Seized by the Federal Police, the agenda contained notes on steps to generate discredit in the electoral process.
“It is unreasonable to find it normal for a four -star GSI general general, to have an agenda with coup annotations, have an agenda preparing the execution of acts to delegitimize the elections, the judiciary and to perpetuate in power,” said the minister.
“I can’t understand how anyone can find it normal, in the 21st century, a coup agenda,” the rapporteur reiterated.

Voting on the merits of the case, Moraes also brought documents seized on the former director of the Brazilian Intelligence Agency (Abin), with false information about the electronic voting process that would then be disseminated by Bolsonaro in one of his Lives.
The minister said it was not “reasonable” the allegation of the defense of branch, which claimed that the documents found in the investigation were records for himself, only to organize thoughts, and that the material would not be presented to anyone.
The minister also pointed out coincidences between Heleno’s agenda and branch material, as notes on a possible use of the Union Attorney General (AGU) to produce legal opinions that support the breach of court decisions by Bolsonaro.
These coincidences, which date from 2021, demonstrate that since then there has been “unit of designs” among members of the coup criminal organization.
This included the use of ABIN as the “counterintelligence center” of the coup, with the production of information and reports against opponents and obstacles of the coup plot, including illegal target monitoring. “Four Supreme Ministers were monitored,” said Moraes.

Judgment
On Tuesday (9), the first class takes up the trial that can condemn Bolsonaro and seven allies for a coup plot that would have act to reverse the result of the 2022 elections.
The group is part of the crucial core of the complaint presented by the Attorney General’s Office (PGR), formed by the main heads of the plot
The trial began last week, when the SUSTION OF THE DEFENSES From the former president and the other accused, in addition to the manifestation of the Attorney General, Paulo Gonet, favorable to the conviction of all defendants.
From this Tuesday, the vote will begin that will result in the conviction or acquittal of the defendants. Sessions were also reserved on September 10, 11 and 12 to finish the trial.

Crimes
All defendants are responsible for the crimes of armed criminal organization, attempted violent abolition of the Democratic Rule of Law, coup, damage qualified by violence and serious threat and deterioration of listed assets.
The exception is the former director of ABIN Alexandre Ramagem who is currently federal deputy. He benefited from the suspension of part of the accusations and responds only to three of the five crimes. The rule is provided for in the Constitution.
The suspension applies to crimes of damage qualified by violence and serious threat against the union’s assets, with considerable damage to the victim and deterioration of overturned assets, related to the scammer acts of 8 January.
