The 6th Chamber of Private Law of the Rio de Janeiro Court of Justice (TJRJ) unanimously denied appeal of the Flamengo Regatta Club to include the company NHJ do Brasil in the process that deals with compensation to the victims of the fire in the Urubu nestwhich caused the death of ten young people from the base team in 2019.
Flamengo claimed that the company, a provider of the containers used as athletes’ accommodation and that caught fire, would be the true responsible for the accident. The defense of Flamengo claimed that containers did not meet contracted safety standards and that the material used was highly flammable, which would have caused the rapid propagation of fire.
The request had already been denied by the 1st Civil Court of Barra da Tijuca, but the club appealed to the TJRJ.
The rapporteur of the case, Judge Sirley Abreu Biondi, upheld the decision of the first instance, noting that “the legal maneuver intended by Flamengo sought only to transfer the responsibility to third parties, which is prohibited by jurisprudence.”
In another excerpt from the decision, the magistrate also argued that it is “inadmissible” the club “to blame exclusively to another.”
With the decision, Flamengo remains solely responsible in the process brought by the Public Prosecution Service of Rio de Janeiro (MPRJ) and the State Public Defender’s Office. Institutions call for the training center ban until it is fully safe, but also the guarantee of resources to fund the individual and collective compensation.
Remember the case
The fire occurred during the night of February 7, 2019, in the housing of the grassroots categories, which was in containers in the training center itself.
At the time of the fire, 26 athletes slept in the accommodation. Ten died, three were injured and 13 managed to escape.
