The Court of Rio de Janeiro ordered the immediate suspension of the public tender promoted by the Municipality of Magé, Metropolitan Region of Rio, to fill 1,500 vacancies for the position of teacher of the Municipal Education Network.
The decision of the 9th Chamber of Public Law occurs within the scope of public civil action filed by the 1st Prosecutor of Magé Collective Guardianship, which pointed to evidence of irregularities in the hiring of the organizing board, the Institute of National Evaluation (IAN), including suspicions of technical inidality and absence of adequate structure for the holding of the contest.
The request for suspension was made by appeal filed by the MPRJ against a decision of the first instance that had denied the injunction to interrupt the competition. The prosecution showed that “the National Evaluation Institute has no physical headquarters, technical staff, technological structure or employees, with strong evidence of a facade company”. He also reported that, during the event, changes were made to the rules of the notice, as in the objective criteria of approval and the rules of correction, in violation of the principles of legality and binding to the notice.
In the decision, the judge wrote that the continuity of the competition could generate legal uncertainty and losses for both public administration and candidates. “With the decision, the convening of new candidates of the public tender 01/2024, as well as the possession and entry of those already summoned, are suspended,” adds the decision.
The starting salary of a teacher from Magé City Hall, according to the announcement of the contest, is R $ 2,189.45.
