The Banking Superintendence, Insurance and AFP (SBS) It fulfills a key role in the protection of public savings. According to Daniel Reátegui, coordinator of supervision of informal activities of the SBS, by constitutional mandate this entity regulates and supervises financial, insurance systems, private pensions and savings and credit cooperatives, in addition to leading the fight against money laundering and terrorism financing.
Within that framework, it is important to differentiate between a supervised and regulated company by the SBS and another that is simply registered in the SBS by legal mandate.
Supervised and regulated companies such as banks, financial, boxes, insurance, AFPs and savings cooperatives are subject to strict standards that seek to guarantee their solidity, sustainability and ability to comply with the commitments assumed in front of their
customers.
The SBS permanently evaluates its risks (credit, market, liquidity, operational and money laundering prevention) and can apply sanctions in case of non -compliance. These entities are authorized to capture public deposits, always under Law 26702.
The registered
On the other hand, there are companies that only register, such as exchange houses, loan companies, among others. Its registration responds to the fulfillment of a norm and its supervision is limited to aspects linked to the prevention of money laundering and terrorism financing. These companies are obliged to report information, but do not have authorization to capture money in the form of deposits or to offer a bank or financial products.
Reátegui warns that several of these registered companies seek to present themselves as regulated to generate trust, offering savings products that are not authorized to provide. This constitutes an infraction to Law 26702 and a crime of unauthorized financial intermediation, typified in article 246 of the Criminal Code.
He said the recommendation is clear: before trusting their savings, users must verify on the official SBS page the list of authorized entities to capture money from the public.
