Congress will decide the future of contributions to political parties at the Bank of the Nation

Any modification in the system of receiving contributions to political parties – so that a collecting account at the Bank of the Nation can receive contributions by interbank transfer or digital wallets such as YAPE or PLIN – requires modifying Law No. 32254 and its regulations.

This was confirmed to Peru21 the BN operations manager, María Luisa Guevara, who said that currently the standard only allows cash or check contributions, or that a natural or legal person with account in the state financial entity transferred from this to the party collecting account.

“Clearly says in the law what are the requirements: effective, check or transfer of an account to the same bank,” he explained. “There should be a modification of the law,” he added when asked about other future options, such as digital wallet or interbank transfer.

The BN operations manager, María Luisa Guevara, spoke with Peru21 about the contributions to the parties.

What the Law on Contributions to Political Parties says

Law No. 32254, approved in January of this year and regulated in March, restores the contribution of private companies to political groups through bank accounts – of the Bank of the Nation or private banks – and modifies the Law of Political Organizations No. 28094.

In article 77 of the Regulation, it indicates that the Bank of the Nation or any private entity can only receive contributions in cash, check or through transfers between open accounts in the same entity. It is not allowed, for example, to make interbank transfers from any bank to the collection account of a party in the BN or another financial entity.

According to Guevara, an alternative for contributors is to open a personal account at the Bank of the Nation and, from there, transfer the funds to the party collection account. However, this option is not entirely practice, as it can only be done in Lima and in three agencies: the Augustinian, Chaclacayo and Bellavista (Callao).

On the other hand, the law and its regulations authorize the use of digital wallets only in the banks that provide that service, but do not contemplate its use in the Bank of the Nation or in other entities not included, as indicated in article 78 of the Regulation of Financing and Supervision of Party Funds of the ONPE.

In the hands of Congress

Last Friday, Peru21 He revealed that the Bank of the Nation only receives cash contributions or check, without option to interbank transfers or payments with digital wallet such as Yape or Plin.

The electoral expert José Tello said that “it would be wonderful” to enable contributions with digital wallet in the state bank.

For his part, the Popular Renewal Congressman, Ezra Medina, announced that he will ask the Economy and Constitution commissions to quote a representative of the Bank of the Nation and the Minister of Economy, Raúl Pérez Reyes, to explain the progress in the implementation of the system of contributions to parties and the facilities for the contributors.

The decision to change the way in which contributions are implemented in collecting accounts of the Bank of the Nation or private banking entities is in the hands of Parliament.

The legislative will have the last word.
