A man was sentenced to 24 years in prison for transfemicide

Judge María Laura Sunhary de las Carreras sentenced a man to 24 years in prison for the femicide of Fanny Aguiar, a trans woman murdered in 2018. The Raúl Iglesias Prosecutor’s Office had asked that he be sentenced for transvesticide, but finally the judge understood that it was a femicide in which there was “contempt and contempt for the victim’s condition as a trans woman.” The prosecutor had asked for 28 years in prison. He had also requested that another man be sentenced who, according to them, had been a participant, but the judge acquitted him.

According to what they declared in the trial, Aguiar (37 years old) had a relationship of approximately two months with a 21-year-old man with whom he even lived together. But on November 15, 2018, after noon, he arrived at her apartment in La Comercial with another man in his 40s. They waited for her at the door, talked briefly, and the three of them went up to the apartment.

They wanted to rob her, but they also had “motives of hatred, contempt and contempt for her”, as Iglesias argued in his opening statement some time ago. There they stabbed her to death. They fled bloodied and one of them tried to take a 13-kilo jug.

In the closing arguments, the prosecutor stressed that they demanded money from her to buy drugs and she refused, so “used excessive violence, brutality, treacherous, clearly motivated by hatecontempt and contempt for that transvestite woman who did not agree to her demands and as an act of discrimination due to her sexual orientation and gender identity”.

The aggressor places the victim’s body outside the law, takes away its character as a person, it is an object of use, of libidinal pleasure, potentially leading to deadly enjoyment, an object of punishment, disposable, even more so in the case of transvestite bodies“, he added. In addition, he stressed that the areas of Aguiar’s body in which the wounds were revealed attacked his “feminine image.”

On the other hand, the attacker took a bath to remove the traces and showed no remorse. According to the prosecutor, Aguiar’s partner “had great internal conflicts of a sexual nature for being in a relationship with a transvestite, since for him Fanny was an object of use, of pleasure, disposable, who could not ignore his requirements as a man” .

“I was living with my parents, my mother gave me a judicial restriction, I came to live in Ciudad Vieja, I began to live in shelters, I met a trans who took me homeI lived with the trans for a week, I went out to distribute resumes, I took drugs and then I killed him,” said Fanny Aguiar’s partner according to a report from the 2019 Criminological Medical Department that she accessed The Observer. He also said that she was sorry because she had taken a person’s life.
