The Federal Court of Accounts (TCU) recommended that the House of Representatives investigate the misuse of public resources, directly or indirectly, by Federal Deputy Eduardo Bolsonaro (PL-SP).
The agency sees evidence of irregularity in the parliamentary stay in the United States and Want to know if the trip is being funded with public money.
The TCU has asked the House to send the outcome of the investigation and the adopted measures. Auxiliary agency of the Congress, the TCU responded to a representation of Deputy Guilherme Boulos (PSOL-SP).
Unanimously, the TCU decided that the judgment of any irregularities is not the responsibility of the agency, for violating due process and the separation of powers. However, he sent the complaint to the House of Representatives and pointed out the need for investigation by the Federal Prosecutor (MPF).
The decision was made last week, but was only released on Friday (8).
In representation, Boulos argued that Eduardo Bolsonaro commits a crime by promoting political articulations against national sovereignty.
According to the PSOL deputy, Negotiation with foreign governments or groups to provoke hostile acts against Brazil is typified by the Penal Code as a crime of attack on sovereigntywith a penalty of three to eight years in prison.
Absence of discount
According to Opinion of the TCU, Eduardo Bolsonaro only justified one of the five fouls to the House sessions in March. At the time, Eduardo Bolsonaro was already in the United States, but had not asked for 122 -day parliamentary license.
The TCU, however, asked the House itself to find out the case, since the lack of discount for the four unjustified absences did not add $ 120,000 of damage to the public coffers, minimum amount for the opening of investigations by the agency.
Boulos had asked TCU to investigate Eduardo Bolsonaro’s criminal liability, but the plenary denied the request, citing the agency’s lack of competence to define the commission of crimes.
If the House refuses the case, this will be the second investigation against the deputy. In July, Federal Supreme Court Minister Alexandre de Moraes extended the inquiry that investigates the deputy’s trip to the United States as a means of articulation against Brazilian authorities.
