Disobedience to a firm resolution is generating a new confrontation in the highest spheres of Peruvian justice.
The president of the National Board of Justice (JNJ), Gino Ríos, warned that the Prosecutor of the Nation would be disregarding a provision that orders the reinstatement of Liz Patricia Benavides Vargas as a supreme prosecutor.

This morning, Ríos sent a letter to the head of the Congress, José Jerí, informing that, despite the repeated official communications, the Public Ministry has not complied with Resolution No. 231-2025-JNJ, issued on June 12.
The trade, sent in response to article 102 subsection 2 of the Constitution, specifies that even the Board of Supreme Prosecutors has been notified without the measure being executed to date.
“In a flagrant and unjustified way, the Prosecutor of the Nation has been ignoring our requirement,” says the president of the JNJ.
The Via Crucis de Benavides
Although the National Board of Justice (JNJ) ordered its immediate reinstatement, Patricia Benavides is still outside the position of Supreme Prosecutor.
Throughout the week of August 5 to 8, 2025, the prosecutor of the Nation, Delia Espinoza, has dilated the execution of this provision, lighting an institutional conflict that threatens to climb.
The tension shot up on August 7, when the president of the JNJ, Gino Ríos, sent a trade demanding that Benavides be answered “in the day” after fulfilling his 60 -day suspension. The answer was silence.
The story has been dragged since December 2023, when Benavides was suspended by alleged irregularities within the framework of the Los Cuellos Blancos del Puerto case.
In June 2025, the JNJ annulled its dismissal; But the breakdown came on August 1, when the Supreme Court left without effect, in the second instance, the suspension of 24 months, considering that there was no parliamentary authorization to impose coercive measures against a high official with constitutional prerogative.
That same day, Espinoza publicly expressed his fear that Benavides could influence criminal investigations against congressmen and officials, and alleged lack of budget to pay his salary.
On August 4, the JNJ replied that there was no legal impediment for its reinstatement and that Resolution No. 231-2025-JNJ was clear in rehabilitating its title.
On August 5, the Board of Supreme Prosecutors urged Espinoza to resolve the case “as soon as possible”, but she sent a trade again asking for clarifications, interpreted as a dilatory maneuver.
Finally, on August 8, the JNJ notified Congress that the Prosecutor’s Office has breached “flagrantly and unjustified” the restitution of Benavides. The pressure increases, and several sectors warn that the Prosecutor of the Nation could face consequences for disregarding a binding resolution.
The Benavides case, marked by its dismissal, political questions and a controversial order of reinstatement, threatens to become an institutional high voltage shock.
