The body camera image of military policeman Danilo Gehrinh shows the man in their 30s, accepting driving by the police of the street where they are under a viaduct. Also appears in the scene his colleague, policeman Alan Walace dos Santos Moreira. They press the man against a wall without it seeming to react. Shortly thereafter, the camera is covered and the man named Jeferson was killed with 3 rifle shots. 
The incident was reported to the Civil Police as death after resistance, accusing the unidentified man of trying to take the gun of the police. According to the prosecutor’s accusation of Sao Paulo, they lied, and Alan executed the man, with the consent and being covered by Danilo and without opposition from the driver of the group, also police officer Alan Eliel Aquino Vieira.
The execution, on the 25th of March Viaduct, downtown São Paulo, led to the request for precautionary arrest of Alan Walace and Danilo, granted on July 22 by Judge Luciana Scorza. She accepted the initial accusation of homicide with clumsy reason and impossibility of defense of the victim, qualifying conditions.
According to the lawsuit, on June 13 the defendants made routine patrol when they decided to approach the man after seeing him coming down from a tree. They found that the victim did not carry documents and took her behind a pillar under the viaduct. There, they executed it. For the prosecution, Gehrinh adhered to the homicidal purpose of his uniformed colleague and placed his hand on the body camera lens at the time of shots to obstruct the execution record. The judge considered that there was “sufficient evidence of authorship and materiality, not the case of injunction, since the initial allows the full identification of the elements of criminal action.”
According to the State Security Bureau, police are detained in the Romão Gomes Military Prison, in the northern zone of the capital. “The Military Police vehemently repudiate the conduct of the military police involved. The general command of the PM, as soon as he learned of the images, immediately requested by the prison of the agents,” says the agency’s statement.
The São Paulo Court accepted the prosecutor’s complaint (MP-SP) against the two military police who became defendants for qualified homicide. The case is investigated by the Police Office and the State Department of Homicides and Protection of Persons (DHPP). Police defenses were not found to comment on the incident.
