House declares loss of mandate to 7 deputies and gives inauguration to substitutes

The House of Representatives declared the loss of mandate of seven federal deputies. The measure meets the decision of the Federal Supreme Court (STF) that changed the interpretation of the rule on the distribution of so -called electoral leftovers in the proportional elections.House declares loss of mandate to 7 deputies and gives inauguration to substitutes

The board of directors of the house published an act on Wednesday (30) confirming the loss of vacancies. In the same publication, the president of the House, Hugo Motta (Republicans-PB), summoned the new deputies, already graduates, for the inauguration as a starter.

They lost federal deputies of Amapá, Federal District, Rondônia and Tocantins. They are: Gilvan Máximo (Republicans-DF); Augusto Puppio (MDB-AP); LEBRÃO (UNION-RO); Lázaro Botelho (PP-TO); Professor Goreth (PDT-AP); Silvia Waiãpi (PL-AP) and Sonize Barbosa (PL-AP).

They were summoned to take office: Professor Marcivânia (PCdoB-AP); Paulo Lemos (PSOL-AP); André Abdon (Progressives-AP); Aline Gurgel (Republicans-AP); Rodrigo Rollemberg (PSB-DF); Rafael Bento (Somos-Ro) and James Dimas (we can-go).

Electoral leftover

By electoral rules, initially can only dispute chairs in the House parties that reach at least 80% of the electoral quotient. In addition, the candidate needs to obtain, individually, votes that correspond to at least 10%of this quotient.

The “leftovers” of the chairs are divided into a second round, in which, in addition to the party needs to reach the 80% of the electoral quotient, the candidate must obtain 20% of this quotient. The increase in the percentage gave rise to a third round to fill the remaining vacancies.

By the interpretation of the Superior Electoral Court (TSE), in the third distribution, the remaining vacancies would only fit the parties that obtained 80% of the electoral quotient, an understanding that was overthrown by the Supreme Court, which understood that all parties competing for the claim could compete in the remaining chairs.

The decision changed the distribution of vacancies between the parties and, consequently, the list of elected. In addition, the Court’s decision also affects the composition of legislative assemblies.
