After the announcement of the president of Colombia, Gustavo Petro, to order the National Navy to block the exit of the ship loaded with coal who sailed from the port of Ciénaga, bound for Israel, portfolio knew exclusively the document with which the Petro government itself, through the Ministry of Commerce, authorized Drummond Ltd to continue mineral exports to Israeli territory, in application of the mechanism to prove the consolidated legal situation or the legitimate expectation established in Decree 1047 of August 14, 2024.

Indeed, the document of the Commerce portfolio recognizes the consolidated legal situation presented by the company and approved for a total of four years the continuity of Drummond coal exports to Israel.

The communication, signed by Luz Belén Fernández Álvarez, Deputy Director of Design and Management of Operations of the Mincomercio, specifies that The company authorized to carry out the commercialization abroad of the mineral to Israeli territory is Drummond Ltd, with the interoceiary Coal Sales LLC and with the client abroad called The National Coal Supply Corporation Limited.
There it is specified that a total of 10.2 million tons of thermal coal, but the amount recognized within the consolidated legal situation is 9.4 million tons.

In the same document the Ministry of Commerce clarified the terms of approval where it says textually that “The recognized amount is approved to be exported between August 20, 2024 and December 31, 2028”

Along these lines, the authorization of Mincomercio ensures that “The competent authorities determined in the aforementioned Decree, in session held on October 22, 2024, studied the application submitted by the Drummond Ltd company, with NIT 800.021.308-5 recognizing the existence of a consolidated legal situation and approving the export of the mineral thermal Hullas (coal) classified in the tariff subheading 2701.12.00.10.10”

He adds that for the purposes of the authorization, the provisions of numeral 4 of article 3 of Decree 1047 of 2024 must be taken into account that says: “The recognition of the consolidated legal situation or of the legitimate expectation issued by the Ministry of Commerce, Industry and Tourism, work as a mandatory support document for the presentation and acceptance of the application for the authorization of shipment, in accordance with the provisions of article 349 of Decree 1165 of 2019”
