In Congress, complaints are not always archived due to lack of evidence, but for lack of votes.
The accusation for organized crime against the former nation of the nation, Patricia Benavides, was ruled out without even entering the debate.
The subcommission of constitutional accusations rejected – with 6 votes in favor, 7 against and 2 abstentions – admit the constitutional complaint filed by the Prosecutor of the Nation, Delia Espinoza Valenzuela, against its predecessor, Liz Patricia Benavides Vargas.
The complaint was not discussed in the background. He died at the door.
The qualification report No. 602, prepared by Espinoza itself from the Public Ministry, did not indicate constitutional infractions. But he raised a list of crimes with his own weight:
Criminal organization, specific passive bribery, improper passive bribery, abuse of authority, personal cover -up and obstruction of justice.
The complaint, step by step
Nothing minor. What exactly were Benavides accused?
According to the document, in his capacity as prosecutor of the Nation, he would have led an alleged criminal network within the Public Ministry. A structure from which investigations would have been manipulated, appointed and removed finger prosecutors, interfered with judicial processes and favored characters with political or personal ties.
The complaint goes further: it indicates that irregular acts would also have been undergoing other prosecutors to archive or stop delicate cases.
All this, with a purpose: use institutional power to obtain personal and political benefits, and ensure impunity for yours.
According to the report, Benavides’ functional decisions would have overflowed the legal and violated limits of the Public Ministry, such as objectivity and legality.
Despite all this, the subcommission chose to close the step. Neither research, nor debate. Direct file.
The case, for now, is buried.
