Acuña, who sustained the report against the Commission, said that the violation of articles 1, 2 (subsection 5), 22, 23, 38, 39 and 45 of the Political Constitution of Peru has not been demonstrated. He also indicated that the evidence presented by the Public Ministry They are not enough to accuse Torres of the crime against public administration.
The SAC entrusted the Congressman Segundo Quiroz to prepare the final report and this concluded that the constitutional complaint against his app colleague lacked evidence. “The archiving of the accusation against Congresswoman Rosío Torres is arranged, which grows from legal, probative and factual livelihood, which prevents continuing with the process,” Quiroz said at the close of reading her report in the session on February 7.
After reading said report, there were no interventions, so it was voting on it. Finally, he was filed with 15 votes in favor, 1 against and 2 abstentions.
On that occasion, after being consulted by a possible armor, Acuña said: “This subcommission is not shielding anyone, everything depends on the vote of the congressmen, we would have to ask each of those who have voted. […] The delegated congressman has concluded the archive after having investigated and not leading to this complaint. ”
Archivan Constitutional complaint against former Minister of Health
On the other hand, in the session of this July 24, constitutional complaints were also filed against the Exminister of Health, Rosa Bertha Gutiérrez Palominowith 19 votes in favor, 4 against and 2 abstentions.
Gutierrez was attributed to the alleged commission of the crime of omission, refusal or delay of functional acts, contemplated in article 377 of the Criminal Code, for alleged irregularities during the pandemic by Covid 19.
It was Patricia Chirinos who filed the constitutional complaint against Gutierrez. “I have submitted DC against the former Minister of Health, requesting its disqualification from any public service for 10 years. Its infractions to our Constitution and the crimes in which they would have incurred, as a guilty homicide and exposure to the danger of death, as merit it,” he said at the time.
