Sentenced to 27 years for selling to his girlfriend

The Criminal Chamber of the Supreme Court of Justice left the sentence of 27 years and 6 months in prison imposed on Jim Sleider Solano Bernabe, who was found guilty of the crime of trafficking in persons for the purpose of sexual exploitation. Such a decision is contained in Judgment 405 drafted by Judge Carmen Marisela Castro and supported by her colleagues in the Criminal Chamber, Elsa Gómez and Maikel Moreno.

The events occurred in the Moñitos neighborhood, Puerto Ayacucho (Amazonas), where the teenager (victim) lived with her boyfriend Jim Solano. Both met at a party and the few days gathered in Jim’s house. “After two weeks the teenager’s torture begins, since the denounced (Jim Solano) took her to live in Colombia, specifically to the town of Carreño,” says the story inserted in the sentence.

“The citizen Jim Solano sells her in Carreño, she said that the money they gave to him, used it to buy alcohol and drugs and then sold it to a Colombian for a certain amount of money.

The person who bought it handed over the money agreed to the teenager and this in turn gave it to Jim Solano. But, if she arrived without silver, the subject “hit her, tied her and abused her.”

Given this situation, the teenager returned to Venezuela and filed a complaint against Jim Solano in the Public Ministry on June 8, 2022.

As a result, the police authorities located the subject and handed it over to the Prosecutor’s Office, where he was charged with trafficking in persons for sexual exploitation. Then, on November 20, 2023, prosecutor Vanessa del Carmen Farfán, requested to open a trial against the accused subject.

The aforementioned trial was agreed and was held from April 22 to July 2, 2024 before the 2 -year Court of Amazonas, which sentenced him to 27 years and 6 months in prison.

This conviction was appealed by Yors Acuña, public defender first with competence in gender violence. On November 1, 2024, the Court (accidental) of Amazonas Appeals declared without a place the Aguña approach and consequently ratified the conviction imposed on Solano, according to the sentence signed by the superior judges Yormar Dailyn Rosales Requena, Mirla Teresa Castro Parra and Yagnelli Josefina Sevilla.

Solano’s defense insists that the conviction be annulled and goes to the Criminal Chamber of the TSJ with a appeal through which he denounces that the trial court discarded in the trial some evidence such as the testimony of the victim’s mother.

In this regard, the magistrates recalled that the Courts of Appeals are not to assess the evidence taken to a trial. For that and other reasons they dismissed the appeal and left the sentence imposed on Jim Solano.
