Opposition classifies from arbitrary precautionary measures against Bolsonaro

Following the determination of precautionary measures to former President Jair Bolsonaro, determined by the Federal Supreme Court (STF) Minister Alexandre de Moraes, opposition parliamentarians and the PL, Bolsonaro party, issued a note classifying Moraes’ decision of “serious episode of political persecution disguised as a lawsuit”.Opposition classifies from arbitrary precautionary measures against Bolsonaro

The note was released early on Friday afternoon (18) and is signed by opposition leaders in the National Congress, Senate and the Chamber of Deputies, Senators Izalci Lucas (PL-DF) and Rogério Marinho (PL-RN) and Deputy Zucco (PL-RS), and PL leaders in the House, Gostenes Cavalcanti (PL-RJ) and Senado, Carlos Portinho (PL-RJ).

In the text, oppositionists say Bolsonaro was the target of “arbitrary” precautionary measures by Moraes, who aim to silence the former president.

“The measures imposed – such as the ban on the use of social networks, communication with foreign diplomats, to maintain contact with political allies and even with his own son, Deputy Eduardo Bolsonaro, besides the imposition of an electronic anklet – do not support themselves legally and injure fundamental constitutional principles, such as due process, the dignity of the human person and proportionality,” says the note.

The text also states that Bolsonaro was not condemned and that, in the opinion of the opposition, there is the use of the judicial apparatus as an instrument of political repression. In the note, parliamentarians still say there is criminalization of opinions, freedom of expression, the right of defense and lawyers’ prerogatives, “all in an attempt to counteract leadership by courts, which endanger democracy itself.”

“The contrast to the recent past is evident. In 2016, Dilma Rousseff spoke in the UN to report an alleged coup. In 2017, Lula’s lawyers went to Europe to question decisions of the Brazilian judiciary. In 2018, the defense of the former president resorted to the UN to prevent his arrest, while he himself, was able to travel abroad to make complaints against Brazilian institutions-without restriction or restriction. Speaking. Why is a former president who was not even convicted now?

For opposition, Bolsonaro’s measures are a smoke curtain to cover up the latest news from the current Lula administration. The note also criticizes the judiciary, stating that power “goes beyond the limits of legality and reasonableness” and that parliament must “react firmly to restore the balance between powers and protect the rights of the people.”

The note concludes also asking the population to comment on the streets. “No position authorizes persecution. No Brazilian must be silenced for thinking differently. We are 213 million free citizens,” says the text.

Opposition deputy Bia Kicis (PL-DF) said that opposition parliamentarians will meet in person to discuss the reactions and will request the end of parliamentary recess.

“We will request the end of white recess, we want a meeting with President Hugo Motta and we want this house not to bend to the dictatorship of the toga,” said the deputy.

In a statement, the president of Congress and Senate, David Alcolumbre (Union-AP), ruled out any possibility of ending parliamentary recess, which began yesterday (17) and ending on August 4.

“During the next two weeks, there will be no deliberative sessions or operation of the commissions,” says the note. “Legislative activities will be resumed in the week of August 4, with deliberative sessions in the Senate Plenary and the Committees, including the beginning of the appreciation and voting of indications of authorities, according to the schedule already disclosed,” concludes the text.

Measures

On the morning of Friday, Moraes ordered Bolsonaro the fulfillment of several precautionary measuresbetween the Electronic anklet monitoring and home collection between 19h and 6am from Monday to Friday and full time on weekends and holidays. The former president may also not maintain contact with ambassadors, foreign authorities or approach embassy headquarters and consulates.

The measures were requested by the Federal Police (PF), with a favorable opinion of the Attorney General’s Office (PGR), in a new inquiry open to investigate the conduct of Bolsonaro and Eduardo against national sovereignty. The organs pointed to the risk of escape from the former president to justify the monitoring by electronic anklet.

In the text, the minister addressed the imposition of A 50% tax on Brazilian products Announced this month by US President Donald Trump, who justified the measure by citing what he called “witch hunt” against Bolsonaro due to the coup process.

“The implementation of the increase in tariffs is intended to create a serious economic crisis in Brazil, to generate political and social pressure in the judiciary and impact diplomatic relations between Brazil the United States,” the minister wrote.

Majority

For Moraes, Bolsonaro and his son Eduardo made a “Flagrant confession” of criminal acts to coerce and obstruct Brazilian justice, which is why the minister decided to impose precautionary measures against the former president.

They are investigated for coercion crimes in the course of the case (article 344 of the Penal Code), obstruction of criminal offense investigation involving criminal organization (article 2, paragraph 1 of Law 12.850/13) and violent abolition of the Democratic Rule of Law (article 359-L of the Penal Code).

Measures were ratified by most of the first class of the Supreme Court. So far, besides Moraes himself, they have voted to maintain precautionary measures the ministers Cristiano Zanin and Flávio Dino. Ministers Cármen Lúcia and Luiz Fux have until 11:59 pm next Monday (21) to vote.
