CNSS orders payment of extrabajador benefits after 10 years of claims

José Regalado Guerrero was diagnosed with shoulder injuries, cervical and lumbar spine linked to his work as heavy machinery operator

SANTO DOMIGO.- A former Falconbridge Dominican company that had more than 10 years claiming its labor benefits before Occupational Risk Insurance (SRL), for its health status, will be compensated after the National Social Security Council (CNSS) ordered the payment of said compensation through resolution no. 616-03, issued on July 11, 2025.

José Regalado Guerrero will receive its benefits after an arduous appeal process, in which the General Directorate of Information and Defense of Social Security Affiliates (DIDA) intervened.

This process sought to reverse resolution no. DJ-GAJ-07-2016 of the Superintendence of Health and Occupational Risks (SISALRIL), which ratified the refusal of the then Occupational Risk Administrator Safe Health (ARLSS), today Dominican Institute for Prevention and Protection of Occupational Risk (IDOPPRIL), to recognize the health condition suffered by Guerrero Guerrero as a derivative of work.

Through the current decision, the CNSS recognized as a occupational disease the osteomuscular lesions that afflict Galado Guerrero, who with more than 35 years operating heavy machinery, suffered severe shoulder injuries, cervical and lumbar column, diagnosed since 2014 and directly linked to their work.

Despite notifying their health status, their claims were rejected in several administrative instances.

The DIDA maintained a constant monitoring of the case, until this important favorable precedent was achieved.

«This ruling sends a overwhelming message that no worker must face only the denial of his rights. We reaffirm our commitment to defend each affiliate until the last consequences, ”said the institution in a statement.

The DIDA reiterated that it will continue to ensure the unrestricted respect of the rights of Dominican workers, reaffirming their mission to ensure that social security is effectively a human right and a pillar of social justice.
