Gino Ríos Patio, current president of the National Board of Justice (Jnj), It has a final sentence for family violence in a modality of psychological abuse, issued in May 2011 by the First Specialized Family Transitory Court of La Molina and Cieneguilla.
The sentence, which was consented and not appealed, is based on the complaint filed by his then wife, backed by psychological expert opinions and evidence of psychiatric treatment. According to the judicial file revealed by fourth power, Ríos incurred acts of intimidation and threats that configured psychological abuse, according to the code of children and adolescents in force at that time.
During the selection process to integrate the JNJ, this information was available in its affidavit, without the Special Commission responsible for the evaluation making observations in this regard. The Organic Law of the JNJ, in its article 4, establishes as a cause of impediment to the position to have a final judgment for family violence.
Lawyer Elena Tello, legal advocate of the former wife of Ríos, reiterated in the Sunday that the president of the JNJ psychologically assaulted her then spouse.
“Mr. Gino Ríos exercised psychological violence with acts of intimidation, threats. It was proven by the psychological expertise and by the psychiatric and psychological treatment that my sponsor carried,” he said.
Ombudsman is pronounced
For his part, the Ombudsman, Josué Gutiérrez, who presided over said evaluation commission, declared that he did not delve into the issue out of respect for third parties involved, such as the children or the ex -wife of the magistrate.
He added that violence was psychological and not physical, thus minimizing the criminal impact of the case. Gutiérrez also defended the legality of the appointment, arguing that there was no retroactive provision that prevented rivers designation, although he admitted that he did not re -ask the judicial antecedent during the interview.
“That type of sentences, which has to do not with physical abuse, not with physical violence, but with the imputation of a strictly psychological issue. I do not minimize it, but there is no sentence that can mean condemning with a fact that perhaps has a punishable connotation,” he said.
Since then, Ríos has actively participated in institutional decisions, including the application of penalties based on criminal records of other members of the justice system, which has generated questions from some sectors about the ethical consistency of these actions.
They ask for their vacancy
Congressmen Héctor Acuña and Susel Paredes have formally requested the vice president of the National Board of Justice (JNJ) to begin the vacancy procedure against the current president of the institution, Gino Ríos. The petition is based on a final judgment for family violence that weighs on Ríos, which, according to legislators, constitutes an express impediment established in the Organic Law of the JNJ itself.
“It is inadmissible that the president of the JNJ, Gino Ríos, remains in office despite having a final judgment for family violence, which constitutes an express impediment according to the organic law of the Board itself,” said Congressman Acuña in his social networks, highlighting the severity of the situation.
