Supreme Court of the United States stops deportations of Venezuelan migrants to El Salvador

The United States Supreme Court issued an order that temporarily prevents the Donald Trump Government Deport a group of at least thirty Venezuelan immigrants arrested in Texas.

Those arrested were in the Bluebonnet detention center, in that city, and would be transferred to the maximum security prison prison of terrorism confinement (CECOT) in El Salvadorunder the invocation of the Law of Foreign Enemies of 1798, a historical norm designed for war times and that Trump invoked since March 12.

The Supreme Court ordered to suspend the expulsions after the appeal filed by the American Union of Civil Libertads, the agency details EFE. The resolution is not definitive.

“The matter is currently pending before the fifth circuit. After the decision of the fifth circuit, the Attorney General is invited to submit a response to this Court as soon as possible. The Government is ordered not Published on the Official Website of the Supreme Court.

The document also details that the resolution was approved by seven of the nine Supreme Judges, with two votes against Judge Clarence Thomas and Samuel Alito, both described by the newspaper The country as “of extremely conservative ideology.”

This is a new episode in the judicial debate that the United States is facing before the invocation of the Law of Foreign Enemies of 1798, a decision backed by the Supreme Court on April 7 with the condition that the accused must be notified of their deportation and must possess a reasonable time to appeal the decision.

US Supreme Court temporarily endorses Trump’s mass deportations

On this occasion, four Supreme Judges showed individually their position against the reactivation of this law that had only used three times, during the 1812 war and the two world contests.

The magistrates argue that the law only authorizes the detention and expulsion in declared war contexts or direct threats of invasion, conditions that are not met in the case of Venezuela or the train organization of Aragua.

In addition, they warn that the application of this law without judicial guarantees represents an authoritarian drift and a risk to fundamental rights, even for US citizens.

This is the second time that deportations are arrested, on April 9, Federal Judges of Texas and New York stopped the deportation process of five Venezuelans.

Emigrants from the South American nation received another support this Friday when a Court of Appeals stopped Trump’s purpose to suspend temporary protection to Venezuelans.
