The Supreme Court of the United States forbade President Donald Trump on Saturday to use the law of foreign enemies to deport Venezuelans to arrest El Salvador. The decision is temporary and is valid until the court analyzes the case definitively.
“The government is instructed not to remove any member of the alleged class of detainees from the United States until the new order of this Court,” says the decision, which had the opposite vote of two of the nine magistrates of the country’s top court.
Until then used only in times of war, the 1798 law was evoked by Trump in mid -March to deport 238 Venezuela immigrants no appeal to the arrest of El Salvador on charges of integrating the criminal organization of Aragua.
Family members of immigrants deported under this law deny the accusations and the government of Venezuela appealed to the United Nations Human Rights Council against deportations.
On April 7, the US Supreme Court authorized the use of the law as long as immigrants had the right to contest deportation. However, human rights organizations appealed to the courts claiming that the Trump government was not respecting the decision.
The American Union for Civil Freedoms (ACLU) represented a group of immigrants in the courts denouncing that new illegal deportations were imminent.

ACLU recalls that at least 137 Venezuelans were removed to El Salvador without due process of law “possibly for the rest of their lives.”
“It remains to be seen if the majority (or perhaps all) of men have no ties to the Aragua train, as the government secretly expelled them from the country and has not provided information about them.”
The organization maintains that the evidence has shown that “many individuals removed to El Salvador under the law of foreign enemies were not members of the Aragua train.”

On Friday (18), President Donald Trump posted a video with alleged criminals being deported to El Salvador. Then he published an interview for the FOX NEWS to defend deportations to the Central American country.
“We don’t need legislation, we need a president,” the US president wrote in the postwith Spanish translation to reach the Latin American audience in the country.
El Salvador
The government of El Salvador, which has been governor for three years through state -of -the -art decrees, has received prisoners sent by the US in exchange for financial aid and “intelligence” of the Trump administration.

“Those who have been removed to El Salvador face damage and threatening prison conditions in CECOT, including electric shocks, beating, simulated drowning and torture instruments in the detainees to try to force gang affiliation confessions,” ACLU added in the lawsuit.
The Immigrant Rights Defense Entity also states that the US government has used doubtful criteria to classify immigrants as members of the Venezuela criminal organization.
“Including physical attributes such as ‘tattoos that denotes Aragua’s train affiliation’ and hands gestures, symbols, logos, graffiti or clothing. Experts studying ADHD explained how none of these physical attributes is a reliable way to identify gang members,” he added.
