The former constitutionalist lawyer Juan Miguel Castillo Pantaleón considered this morning as very serious the decision of the Constitutional Court to grant nationality to more Haitians who live illegal in the Dominican Republic, because in his sentence he violates the Constitution and has breached his primary obligation that is to guarantee the application of justice.

“The argument of the Constitutional Court lacks a legal basis, the base is the Decree of Naturalization, which is Decree 262-20, had previously been sued in unconstitutionality by a number of people, among which lawyers are, the first of which is the one who speaks to them, and that the Ministry of Interior and Police had said that the aforementioned decree issued in the last days of the last government of Danilo Medina lacked the legal base,” he said.

The exjuez denounces the lack of legal basis in the Judgment TC 0067/25 on naturalization

He denounced that as long as the TC orders to nationalize a group of illegal, “the unconstitutionality action that interpose against the naturalization decree #262-20 has not failed, which benefited those 750 Haitians of which these thirty and so many are part.”

The Judgment TC 0067/25 that orders the Ministry of Interior and Police to nationalize 30 Haitians, was issued by the High Court on March 28, of the current year.

He accused the high court of committing prevarication, since he denies justice, because without failing a case of unconstitutionality against the naturalization of a group of illegal Haitians submitted 5 years ago, now issues a sentence in favor of those nationals.

Castillo Pantaleón says that this decision compromises the rule of law in the Dominican Republic

“The recent decision of the Constitutional Court, which is Judgment 067 of the year 2025, in matters of amparo has ordered the Interior Ministry and Dominican police as thirty Haitians, thus revoking a decision of the contentious-administrative jurisdiction that had rejected that claim, lacks the basis,” he said.

He added that “the basis of that naturalization decree, which is Decree 262-20, had previously been sued in unconstitutionality by a number of people, among which lawyers are, the first of which is the one who speaks to them, the Ministry of Interior and Police had even rendered a report to the President of the Republic pointing out that this decree given during the transition of the last days of the government of Danilo Medina did not contain the minimum compliance Naturalization, lacks elementary documentation to be granted this privilege to these foreigners. ”

He regretted that although Decree 262-20 was sued in constitutionality, the Constitutional Court five years of its claim has not ruled.

“However, legitimizes its absolutely illegal and unconstitutional content, this is very serious, its primary obligation has breached, the precedent, therefore, is extremely serious and compromises the validity of the rule of law and the Constitution of the Republic. It is a true penalty that this has been made from the Constitutional Court itself,” he said.

The sentence

On March 28, the Constitutional Court issued the Judgment TC/0067/25, in which it hosts an appeal submitted by a group of illegal Haitians and orders the Ministry of Interior and police to sworn them as Dominicans. The decision occurs when the government announces 15 measures to face illegal immigration.
