The Permanent Commission of the Congress gave Luz Verde, by majority, to the report proposed by constitutionally denounced former president Francisco Sagasti and disable it for ten years of the year to the public service.
The alleged violation of articles 45, 139 and 172 of the Constitution is charged, in addition to the crime of abuse of authority.
The document indicates that Sagasti issued supreme resolutions that allowed the retirement pass of 16 general officers of the National Police and three general lieutenants irregularly.
It is also attributed to have dismissed the reconsideration resources presented by those affected and have designated a new general commander of the PNP without due process.
The vote of the accusation was 18 in favor, four against and two abstentions.
The 10 -year disqualification result was 22 in favor, three against and zero abstentions.
After the approval of the report, the case will become voted in the plenary.
The delegate of the preparing of the report, the congressman of Honor and Democracy, Jorge Montoya, supported the complaint.
Former President Sagasti attended the hemicycle with his lawyers Carlos Rivera and José Ugaz to support his defense in the Permanent Commission.
According to Rivera, Sagasti acted according to law by signing the resolutions of the dismissals.
According to Ugaz, the decision of the report “is a political revenge.”
“It is absolutely demonstrated that the decision to move to these generals was strictly framed in the Constitution and laws. I trust that the members of the Permanent Commission will dismiss (the report),” said Sagasti.
“I did not abuse or commit arbitrary acts,” he said.
Due to the two deaths from the protests after the vacancy of Martín Vizcarra, he made the decision, on the recommendation of the Minister of the Interior, to change the general commander of the Police.
According to Sagasti, the decision to appoint the new general commander of the PNP was due to a history of his career and not for favor.
The report against Sagasti also includes denouncing and disqualifying them as Sagasti to the former interior ministers, José Elice and Rubén Vargas.
