Minister Alexandre de Moraes of the Federal Supreme Court (STF), said on Friday (14) that the defense of former President Jair Bolsonaro has guaranteed broad access to the evidence of the inquiry that investigates the coup plot to prevent the third term of the term President Luiz Inacio Lula da Silva.
The statement is in the decision in which Moraes dismissed the request made by Bolsonaro’s defense to gain access to the full probative set of the investigation, including the mirroring of cell phones, computers and Pen Drives seized.
According to lawyer Celso Vilardi, the measure is necessary to ensure that the defense is exercised with “parity of weapons”.
In the decision, the minister said that Bolsonaro’s lawyers have always had “full access” to the file, including before the investigation of the investigation.
“As it turns out, broad access to the evidence already documented in the file is fully guaranteed to the defense of the investigated, including the applicant Jair Messias Bolsonaro, which will remain until the closure of the investigation,” he said.
In November last year, former President Jair Bolsonaro was indicted by the Federal Police (PF) for the crimes of coup, violent abolition of the Democratic Rule of Law and criminal organization.
The accusations are part of the so -called inquiry of the coup, whose investigations have concluded that a coup plot to prevent Lula’s third term.
The Attorney General’s Office is expected to report the former president and others accused to the Supreme next week. If the complaint is accepted by the court, Bolsonaro will be a defendant and will respond to criminal proceedings.
